Terms & Conditions
These terms govern the services ALMOTMAKEN Documents Clearing Services provides and your use of this website. They set out what we do, what we charge, what we need from you, and — importantly — what we can and cannot promise.
1. About these terms
These terms are between you and ALMOTMAKEN Documents Clearing Services, a company licensed by Dubai's Department of Economy & Tourism under Licence No. 941604, with its office in Business Bay, Dubai, United Arab Emirates. In these terms "we", "us" and "our" mean ALMOTMAKEN; "you" means the client.
By engaging us, instructing us, paying an invoice, or using this website, you accept these terms. Where we issue you a separate written proposal, quotation or service agreement, that document takes precedence over these terms to the extent it conflicts.
2. Our services
We provide business setup and documents clearing services in the UAE, including:
- Mainland and free zone company formation, and offshore company registration.
- Trade licence issuance, amendment and renewal.
- Residence, investor, employment, family and Golden Visa processing.
- PRO services and government liaison.
- Document clearing, attestation and legal translation coordination.
- VAT and corporate tax registration support.
- Corporate bank account introductions.
The exact scope of any engagement is what is written in your quotation or proposal. Anything not listed there is not included.
3. What we are not
We are a documents clearing and business setup consultancy. We are not a law firm, an audit firm, a licensed tax agent, a bank, or a government authority, and nothing we provide should be treated as legal, tax, accounting or investment advice.
We prepare and submit applications, and we explain how processes work in practice. Where a matter requires formal legal, tax or audit advice, you should engage a suitably licensed professional. We are happy to refer you to one.
4. Quotations and engagement
Prices shown on this website, including in the free zone cost calculator, are indicative estimates for budgeting only. They are not offers and do not bind either of us.
A binding engagement begins only when we issue you a written quotation for your specific requirement and you accept it in writing and pay any amount due to start. Written quotations are valid for the period stated on them, or 14 days if no period is stated, because government and free zone fees change.
5. Fees and government charges
Your quotation separates two different kinds of cost:
| Type | What it means |
|---|---|
| Our service fee | What we charge for our work — preparing, submitting and following up your application. |
| Government and third-party fees | Amounts payable to authorities, free zones, typing centres, medical centres, attestation bodies and similar. We collect these and pass them on at cost. We do not control them and they can change without notice. |
If a government or third-party fee changes after your quotation is issued but before it is paid, we will tell you and the revised amount will apply. Fees are exclusive of VAT unless stated otherwise; VAT is charged where applicable under UAE law.
6. Payment terms
- Government and third-party fees are payable in advance. We cannot submit an application before the authority's fees are funded.
- Our service fee is payable as set out in your quotation.
- We may pause work on your file if an invoice is overdue.
- Payments are made in AED unless otherwise agreed. Bank charges and currency conversion costs are yours.
- We issue a receipt or tax invoice for every payment.
7. Your responsibilities
To do our work we rely on you. You agree to:
- Give us accurate, complete and truthful information and documents.
- Provide genuine, valid and unaltered documents. Submitting forged or falsified documents to a UAE authority is a criminal offence and we will not do it.
- Respond promptly to requests for information, signatures or attendance — many steps have deadlines set by the authority, not by us.
- Attend in person where required, for example for medical tests, biometrics or bank appointments.
- Tell us of anything that may affect your application, including previous visa refusals, immigration bans, criminal records, or existing UAE companies or visas.
- Comply with UAE law and with the conditions of any licence or visa obtained.
If a delay, rejection or additional cost arises because information you gave us was inaccurate, incomplete or late, that is not our responsibility and our fee remains payable.
8. Government approvals
What we guarantee is our work: that we will prepare your application properly, submit it correctly, follow it up diligently, and keep you informed.
If an application is rejected, we will tell you the reason given, advise on whether it can be corrected and resubmitted, and quote for any further work. Government fees already paid to an authority are generally not refundable on rejection, and our service fee for work already performed remains payable.
9. Timelines
Any timeframe we give you — on this website, in a quotation or in conversation — is a good-faith estimate based on how long the process normally takes. It is not a guarantee and does not form part of our contract.
Processing times depend on the relevant authority and are affected by system downtime, inspections, additional approvals, public holidays and periods of high demand. We are not liable for delays caused by an authority, a free zone, a bank or any other third party.
10. Third parties
Delivering your service requires dealing with government authorities, free zone authorities, banks, typing centres, approved medical centres, attestation bodies and translators. We select and coordinate them with reasonable care, but they are independent of us.
Where we introduce you to a bank, we are making an introduction only. Account opening, approval and ongoing compliance are entirely the bank's decision. We are not responsible for a bank's refusal, its conditions, or its timeframes.
11. Your documents
We handle original documents such as passports and certificates only where a process requires it, and we return them to you as soon as the step is complete. We keep a record of documents received and returned.
While documents are with us or with an authority, we take reasonable care of them. We are not liable for loss or damage occurring while a document is in the possession of a government authority, courier or other third party. We recommend you keep certified copies of anything irreplaceable.
How we handle your personal information is set out in our Privacy Policy.
12. Cancellation and refunds
- Before any work begins — if you cancel before we have started and before any fee has been paid to a third party, we refund what you have paid, less any transaction charges.
- After work has begun — we refund the portion of our service fee covering work not yet performed. Work already done is payable.
- Government and third-party fees — once paid to an authority, free zone, medical centre or similar, these are generally non-refundable, whether or not the application succeeds. We will tell you before we pay any such fee.
- Refund method — refunds are made to the original payment method, normally within 14 working days of agreement.
If you are unhappy with our service, tell us first. Most issues are resolved quickly once we understand the problem.
13. Confidentiality
We treat your information and documents as confidential and disclose them only as needed to deliver your service, or where required by law or a regulator. This obligation continues after our engagement ends.
14. Website use and content
The content of this website — text, design, graphics, logos and tools including the free zone cost calculator — belongs to ALMOTMAKEN or is used with permission. You may view and print it for your own use. You may not copy, republish or use it commercially without our written permission.
Website content is provided for general information. Free zone names, government authority names and third-party trade marks are the property of their respective owners and are used for identification only. We do not claim to represent or be endorsed by any free zone or authority except as our licence permits.
We take care to keep the site accurate but do not warrant that it is complete, current or error-free. Do not rely on it as a substitute for a written quotation or professional advice.
15. Limitation of liability
Nothing in these terms excludes liability that cannot lawfully be excluded under UAE law, including liability for fraud or for death or personal injury caused by negligence.
Subject to that, and to the maximum extent permitted by law:
- Our total liability arising from an engagement is limited to the service fee you paid us for that engagement, excluding government and third-party fees passed through at cost.
- We are not liable for indirect or consequential loss, including loss of profit, business, contracts, opportunity or reputation.
- We are not liable for decisions of government authorities, free zones or banks, including refusals, conditions or delays.
- We are not liable for loss arising from inaccurate, incomplete or late information provided by you.
16. Events outside our control
We are not liable for failure or delay caused by events beyond our reasonable control, including changes in law or government policy, suspension of a government system or portal, public holidays, strikes, epidemics, natural events or utility and communications failures. Where such an event occurs we will tell you and resume as soon as we reasonably can.
17. Termination
Either of us may end an engagement in writing. On termination you remain liable for our fees for work performed up to that date and for government and third-party fees already incurred.
We may end an engagement immediately if you ask us to do something unlawful, if you provide documents we believe to be falsified, if you fail to pay, or if continuing would breach our own licensing or anti-money-laundering obligations.
18. Governing law and jurisdiction
These terms and any engagement are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute, save that we may bring proceedings where you are located to recover sums due.
Before starting proceedings, both of us agree to attempt in good faith to resolve any dispute by discussion.
19. Changes to these terms
We may update these terms. The "last updated" date at the top shows when they were last revised. The terms that apply to your engagement are those in force when your quotation was accepted.
Questions about these terms?
Ask us before you engage — we would rather explain something twice than have it misunderstood.
